1. Introduction and acceptance of terms

These Terms of Service (“Terms”) govern your use of darkounity.com and the services we provide through the site. By accessing or using the site, you agree to these Terms. If you do not agree, please do not use the site. Our Privacy Policy explains how we collect and use data; both documents apply. No checkbox or explicit agreement is required; use of the site constitutes acceptance.

2. Definitions

“Site” means darkounity.com. “We,” “us,” and “our” mean Tomicz Engineering LLC. “You” and “your” mean the visitor or user. “Services” means the website and all features described below. “Content” means text, images, and other materials on the site or submitted by users (e.g. interview responses).

3. Description of services

We provide:

  • Website and blog: Informational content about Unity development, tutorials, and related topics.
  • Newsletter: Email updates via Brevo; signup and unsubscribe as described in the Privacy Policy.
  • Contact form and mentorship inquiries: You may submit messages or enrollment requests; we use EmailJS to receive and respond.
  • Interview tool: Unique links where you may submit name or nickname, answers, images, and optional links; we use this to create draft blog content that may be edited and published on the site.
  • Roadmaps: View-only roadmaps (some password-protected); passwords are set by the site owner.
  • Booking: Links to Calendly for scheduling calls or meetings; Calendly’s terms apply to the booking experience.

We may change, suspend, or discontinue any part of the services with reasonable notice where practicable. We do not guarantee uninterrupted availability.

4. User eligibility and responsibilities

The site is not directed at children under 13 (or 16 where applicable). By using the site, you represent that you meet any age requirements in your jurisdiction and have authority to agree to these Terms. You should provide accurate information when contacting us, signing up for the newsletter, or using the interview tool.

Acceptable use. You must not:

  • Use the site for any illegal purpose or in violation of any laws.
  • Attempt to gain unauthorized access to any part of the site, other users’ data, or our systems.
  • Transmit malware, spam, or harmful or offensive content.
  • Scrape, harvest, or automate access in a way that burdens the site or violates our instructions.
  • Impersonate others or misrepresent affiliation.
  • Harass, abuse, or send threatening or offensive messages via the contact form or any other channel.
  • Share, forward, or disclose unique interview links to others; each link is intended for the recipient only.

5. Intellectual property

Our content: Text, images, logos, design, and other materials on the site are owned by Tomicz Engineering LLC (or our licensors). You may not copy, modify, distribute, or create derivative works without permission, except for personal non-commercial use (e.g. reading, sharing a link). If you quote, republish, or reuse our blog or other content elsewhere, you must source and cite darkounity.com (and the specific page or article) clearly.

User content (interview tool): By submitting interview responses, images, and links, you grant us a non-exclusive, royalty-free, worldwide license to use, store, edit, publish, and display that content in connection with the site (e.g. creating and publishing blog posts). You represent that you have the rights to grant this license and that the content does not infringe third-party rights.

6. Copyright and DMCA

All original content on the site is protected by U.S. copyright law. If you believe content on the site infringes your copyright, you may submit a written notice under the Digital Millennium Copyright Act (DMCA) to our designated agent. The notice must include: (a) identification of the copyrighted work, (b) identification of the infringing material and its location on the site, (c) your contact information, (d) a statement that you have a good-faith belief the use is not authorized, and (e) a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We may terminate access for users who repeatedly submit infringing content. If you believe your content was removed in error, you may submit a counter-notice with the information required by the DMCA. We will forward it to the original complainant and restore the content within 10–14 business days unless the complainant files a court action.

7. Pricing, payment, and termination

Most of the site (blog, newsletter signup, contact, roadmaps, interview tool when invited) is free. If we offer paid mentorship, courses, or other paid services, we will state payment methods and currency. We do not offer a standard refund policy; you may contact us to request a refund and we may consider such requests at our discretion. We may suspend or terminate your access for violation of these Terms or for other legitimate reasons. You may stop using the site at any time (e.g. unsubscribe from the newsletter, stop visiting).

8. Privacy and data protection

Use of the site is also subject to our Privacy Policy, which describes what data we collect, how we use it, who we share it with, and your rights. By using the site, you acknowledge that you have read (or had the opportunity to read) the Privacy Policy.

9. Disclaimers

Blog posts, tutorials, and other content are for general informational and educational purposes only. They do not constitute professional advice (e.g. legal, financial, or career advice). You rely on the content at your own risk. The site and services are provided “as is” and “as available.” We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties to the fullest extent permitted by law. We do not guarantee any particular outcome from using the site, subscribing to the newsletter, or participating in mentorship or other services. Links to or use of third-party services (e.g. Calendly, Brevo, Google) are subject to those providers’ terms and policies; we are not responsible for their availability, content, or practices.

10. Limitation of liability

To the fullest extent permitted by law, Tomicz Engineering LLC and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or business) arising from your use of the site or services, even if advised of the possibility of such damages. Our total liability for any claims related to the site or these Terms shall not exceed the amount, if any, that you have paid to us in the twelve (12) months preceding the claim, or one hundred US dollars (USD 100), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the maximum permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tomicz Engineering LLC and its owners, employees, and affiliates from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the site or services, (b) your violation of these Terms, (c) your violation of any law or third-party rights, or (d) any content you submit (e.g. interview responses) that infringes or violates third-party rights or these Terms.

12. Governing law and dispute resolution

The Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the site shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there. We do not use arbitration; disputes go to court.

13. Changes to these terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. For material changes, we will give reasonable advance notice before the new terms take effect (e.g. by notice on the site or, where appropriate, by email to newsletter subscribers). Continued use after the effective date constitutes acceptance. If you do not agree, stop using the site.

14. General provisions

These Terms, together with the Privacy Policy and any other referenced policies, constitute the entire agreement between you and Tomicz Engineering LLC regarding the site. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision does not waive that right or provision. We may assign our rights and obligations under these Terms; you may not assign without our consent.
